The owner's professional activity is governed by the General Statute of the Spanish Legal Profession (Royal Decree 135/2021), the Code of Conduct of the Spanish Legal Profession and the rules of the ICAM.

2. Purpose

The website www.tramitacionex.com (the "Website") provides users with information on the legal advisory and immigration processing services offered by the owner, as well as the possibility of contracting them online through the client area in accordance with the General Terms of Engagement published on the Website.

Anyone accessing this Website assumes the role of User, undertaking strict observance of the provisions set out herein and any other applicable legal provision. TramitacionEx reserves the right to modify any information that may appear on the Website without prior notice; publication on the Website itself shall be deemed sufficient.

3. Privacy and data processing

Where access to certain content or services requires personal data, Users guarantee its truthfulness, accuracy, authenticity and validity. The owner will process such data in accordance with its nature or purpose, as set out in the Privacy Policy.

4. Intellectual and industrial property

The User acknowledges and accepts that all content displayed on the Website — including designs, texts, images, logos, icons, buttons, software, trade names, trade marks or any other signs susceptible of industrial and/or commercial use — is subject to intellectual and industrial property rights. All rights belong exclusively to the owner and/or third parties holding the exclusive right to use them in commerce.

The User undertakes not to reproduce, copy, distribute, make available or otherwise publicly communicate, transform or modify such content, holding the owner harmless from any claim arising from breach of these obligations. Access to the Website does not imply any waiver, transfer, licence or assignment of these rights, save where expressly provided otherwise.

5. User obligations and liability

The User undertakes to use the Website lawfully, provide truthful information, equip themselves with the technical means required for access, and refrain from unauthorised or fraudulent use of the Website, accessing restricted areas without meeting the conditions, damaging physical or logical systems, introducing viruses, attempting to manipulate third-party data, or reproducing/distributing content without authorisation.

Where a password is provided to the User, they must use it diligently, keep it confidential, not transfer it to third parties and notify the owner of any improper use.

6. Liability

The owner does not guarantee continuous access to, or the correct visualisation, downloading or usefulness of, the elements and information contained on the website, which may be impeded, hindered or interrupted by factors beyond its control. The owner is not liable for decisions taken as a result of accessing the content.

The User shall hold the owner harmless against any damages arising from third-party claims as a consequence of their access or use of the Website, including the use of robots, spiders, crawlers or similar tools to harvest or extract data.

7. Hyperlinks

The User undertakes not to reproduce the Website or any of its content in any way, including by hyperlink, save with the owner's express written authorisation. The Website may include links to third-party sites. The owner is not responsible for the content of those sites.

8. Data protection

To use TramitacionEx services, the User must provide certain personal data. The owner will process such data and apply the corresponding security measures, in compliance with the GDPR, LOPDGDD and LSSI-CE. The User may consult the data processing policy in the Privacy Policy.

9. Cookies

The Website uses cookies for functions deemed essential, to maintain the User session in the client area, to manage their preferences and, subject to consent, to measure user behaviour and display personalised advertising on third-party platforms. Full details in the Cookies Policy.

10. Force majeure

The owner shall not be liable in case of inability to provide the service if such inability is due to prolonged interruptions in electricity supply, telecommunications, social conflicts, strikes, rebellion, explosions, floods, government acts and omissions or other force majeure events.

11. Dispute resolution. Governing law and jurisdiction

These terms of use, as well as the use of the Website, shall be governed by Spanish law. Where the User qualifies as a consumer or user, the courts of the consumer's domicile shall have jurisdiction (article 90.2 TRLGDCU). Otherwise, the courts of Madrid shall have jurisdiction.

If any provision becomes unenforceable or void, this shall not render the conditions unenforceable or void as a whole; the affected clause shall be replaced by another valid and enforceable provision that, to the extent possible, achieves the original objective and intent.

2. Processing purposes

Provision of the contracted professional service: case study, advice and processing of immigration files (arraigo, renewals, family reunification, EU family member card, residence and work, residence for minors, student stay and residence as family of a Spanish national). Identifying, contact, financial, academic, employment, family and, where required for the file, health data may be processed.
Handling of information requests, queries, complaints and suggestions through the contact channels available on the Website.
Communications management, including email and, where applicable, instant messaging such as WhatsApp where the User initiates the conversation or expressly authorises this channel.
Compliance with legal obligations applicable to the practice of law: bar, tax, accounting and anti-money-laundering obligations.
Sending own commercial communications regarding services analogous to those contracted, regulatory updates and the firm's publications, where consent has been given or there is a prior contractual relationship, in accordance with article 21 LSSI-CE.
Analysis and improvement of the Website: use of cookies and similar technologies as set out in the Cookies Policy, with prior consent where required.

3. Legal bases

Performance of a contract (art. 6.1.b GDPR): for the provision of the contracted service and pre-contractual measures.
Compliance with a legal obligation (art. 6.1.c GDPR): tax, accounting, bar and AML obligations.
Consent (art. 6.1.a GDPR): for commercial communications by electronic means to non-clients and for non-strictly-necessary cookies. Consent may be withdrawn at any time.
Legitimate interest (art. 6.1.f GDPR): to ensure the security of the Website, prevent fraud and maintain service quality.

Users guarantee that the personal data provided is true, accurate, complete and up to date, being solely responsible for any damage that may result from breach of this obligation.

4. Retention periods

Client data: for the duration of the contractual relationship and, after termination, for the periods legally required to address possible liabilities, in particular for a minimum of five (5) years and, for the lawyer's professional documentation, for the period set by applicable bar and procedural rules.
Information requests without subsequent contracting: up to twelve (12) months from the last interaction, unless additional legal or contractual retention applies.
Consent-based data: from collection until the data subject withdraws consent.
Tax and accounting data: for the legally required periods, generally six (6) years under the Commercial Code and four (4) years under the General Tax Law.

5. Recipients

TramitacionEx respects your privacy and, save in cases required by law or necessary for the performance of the engagement, will not disclose your personal data to third parties without your free, specific, informed and unequivocal consent. Data may be communicated to:

Immigration Offices, Government Sub-Delegations and other bodies of the Spanish State and regional administrations.
State Security Forces and Bodies, where applicable.
Spanish Tax Agency, General Treasury of Social Security and other competent public authorities.
Notaries and Public Registers where required by the engagement.
Courts, Tribunals and Public Prosecutor's Office in case of contentious-administrative or other proceedings.
External collaborators of the firm (procurators, sworn translators, collaborating lawyers), bound by confidentiality and professional secrecy.
Technology and professional service providers (web hosting, Stripe payment gateway, document management tools, accounting and tax advisors), always as data processors under article 28 GDPR.

Where any processor is located outside the European Economic Area, TramitacionEx will adopt the appropriate safeguards under Chapter V of the GDPR (Standard Contractual Clauses, adequacy decisions or equivalent guarantees).

6. Cookies

TramitacionEx uses cookies on its Website for technical purposes (maintaining the user session in the client area and protecting forms against CSRF attacks), preference purposes (remembering cookie consent and selected language) and, with consent, marketing (measuring social media advertising campaigns). 7. Security measures

TramitacionEx has adopted the technical and organisational measures necessary to prevent the destruction, loss, misuse, accidental or unlawful alteration, unauthorised disclosure or access and theft of personal data, considering the state of the art, implementation costs and the nature, scope, context and purposes of processing.

For services that require user registration, you must choose a password for which you will be solely responsible. You undertake to keep it confidential and to notify TramitacionEx of any unauthorised use or other security breach.

8. Data subject rights

Access to your personal data and a copy thereof.
Rectification of inaccurate or incomplete data.
Erasure ("right to be forgotten") where the data are no longer necessary for the purposes for which they were collected.
Objection for reasons relating to your particular situation, including objection to direct marketing at any time.
Restriction of processing in the cases of article 18 GDPR.
Portability in a structured, commonly used and machine-readable format where processing is based on consent or contract and carried out by automated means.
Withdrawal of consent previously given, without affecting the lawfulness of prior processing.
Not to be subject to automated decisions producing legal effects or significantly affecting you.

You may exercise your rights by writing to dpo@tramitacionex.com or by post to the professional address indicated in clause 1, providing a copy of your ID, residence card or passport. You may also lodge a complaint with the Spanish Data Protection Agency (www.aepd.es).

9. Third-party links

The Website may contain links to other websites (e.g. AEPD, ICAM, Ministry of the Interior or European Commission). TramitacionEx is not responsible for the privacy practices or content of those websites.

10. Modification of the Privacy Policy

TramitacionEx may modify this Privacy Policy to adapt to legislative or jurisprudential developments and to firm practices. In such cases, changes will be announced on the Website with reasonable notice prior to taking effect.

1. What are cookies?

A cookie is a small text file that a website stores on your computer, tablet or mobile phone when you visit it. Cookies allow the Website to recognise your device on subsequent visits, remember your preferences and improve the browsing experience. The term "cookies" also covers similar technologies such as pixels, web beacons, SDKs and browser local storage (Local Storage / IndexedDB).

This policy is published in accordance with article 22.2 of Spanish Law 34/2002 (LSSI-CE), the Spanish DPA Cookies Guide, the GDPR and the LOPDGDD.

By ownership: first-party (managed by the Website owner) or third-party.
By duration: session (deleted on closing the browser) or persistent.
By purpose: technical, preference, analytical and advertising.

3.1 Technical cookies (strictly necessary)

Essential for the proper operation of the Website and the use of the client area. Do not require consent under article 22.2 LSSI-CE and the AEPD guidelines.

XSRF-TOKEN — first-party (tramitacionex.com). CSRF security token. Duration: 2 hours.
tramitacionex_client_session — first-party. Maintains the user session in the client area. HttpOnly and Secure. Duration: 2 hours.
tramitacionex_admin_session and tramitacionex_lawyer_session — first-party. Independent sessions for internal portals (administration and partners). Issued only when the User accesses those areas.

3.2 Preference cookies

tn_cookie_consent — first-party. Stores the User decision in the cookie banner. Duration: 12 months.
tn_lang — first-party. Remembers the language selected by the User. Duration: 12 months.

3.3 Marketing and behavioural advertising

Installed only with express prior consent. Allow measuring the effectiveness of advertising campaigns on social networks and showing personalised ads on Meta platforms (Facebook and Instagram).

4. Auxiliary services without persistent cookies

Google Fonts (Google Ireland Ltd.): font loading. Google may process the IP address when serving the files. No persistent cookies on this site.
jsDelivr (Prospect One): technical CDN for open-source libraries. No cookies.
Stripe (Stripe Payments Europe Ltd.): only during payment flow; cookies apply on Stripe's domain, not on tramitacionex.com.

5. International data transfers

Some third-party cookie providers (in particular, Meta Platforms Ireland Limited) may transfer personal data to the United States. These transfers are covered by the appropriate safeguards under Chapter V of the GDPR, in particular by the EU–US Data Privacy Framework approved by the European Commission's adequacy decision of 10 July 2023, and where applicable by the Standard Contractual Clauses approved by the European Commission.

6. How to configure or delete cookies

On first access to the Website a banner appears allowing you to accept all cookies, reject them all or configure them by category. You can change your choice at any time by clicking the preference management button in the footer.

7. Consequences of rejecting cookies

If you reject cookies, you can still browse the Website and contract the professional services normally. However, certain features — such as the client area — require strictly necessary technical cookies, so blocking them in the browser may prevent access to those areas. Rejecting marketing cookies does not affect the provision of the professional service.
